Road Maintenance

The liability for road conditions arises whenever a vehicle accident occurs because of or is attributed to slippery conditions. Unless a major highway, the municipality is responsible for keeping a roadway in a reasonable state of repair so that users exercising ordinary care may travel upon it safely. While accidents happen due to many factors, including the plaintiff’s negligence, the defence must be prepared for the merits of a third-party claim against the road authority. We work with municipalities, engineers and investigators to help assess the state of the roads and that other hazards such as inadequate road markings did not contribute to the accident.
