Bio

Yulia Pesin was called to the Bar in 2012 and joined Hughes Amys' Toronto office as an associate in July 2015. Previously, she was an associate with a prominent insurance defence litigation boutique.

Yulia practices in insurance coverage and civil litigation in the areas of personal injury, property damage, occupiers' liability, professional negligence and subrogation. She is a member of the Law Society of Upper Canada, the Canadian Bar Association and the Ontario Bar Association.

Yulia is an avid litigator who passionately advocates on her clients' behalf. She works collaboratively with her clients and adopts a conciliatory approach to ensure that her clients' interests always prevail.

Yulia earned her JD from Osgoode Hall Law School in 2011. She received a BA (Hons) in History and Psychology from York University in 2008, graduating with summa cum laude distinctions.

In her spare time, Yulia enjoys reading political and history novels, travelling and spending time with her husband and two young daughters.

The Expanding Scope of the Absolute Pollution Exclusion

The "absolute pollution exclusion" is a standard exclusion clause commonly found in Commercial General Liability ("CGL") policies. It purports to preclude coverage for losses arising out of the discharge or escape of pollutants at or from an insured's premises. The term "pollutant" is commonly defined in CGL policies as including "any solid, liquid, gaseous or thermal irritant or contami-nant, including smoke, vapour, soot, fumes, acids, alkalis, chemicals and waste. Waste includes materials to be recycled, reconditioned or reclaimed".
